Ex is threatening me with court if i go back to my current girlfriend, and the ex is saying because my girlfriend is dangerous, but my daughter showed me a recording of my ex and her boyfriend, proving the danger she's putting my kids in by being with her boyfriend, and their conversation was recorded by my ex on my daughters phone, and saved so she could use it against her boyfriend someday if she wanted to. It proves her ex's boyfriend is dangerous and its my proof. Can I use it to take her back to court??
I'm not in CA.
An attorney would need to listen to the recording to make a judgment about its use as evidence. There are court rules governing evidence. Additionally, in family law cases there is often a different procedure with relaxed rules of evidence, because so many people represent themselves in family law cases.
The legality of the recording might be an issue also. CA appears to be a two party state and it sounds like your ex did not have permission to record.
