I was 30 days late on my assessment payment. I received a final notice and demand letter from the condo's association attorney, stating I must pay in 30 days and they also included an additional 250.00 attorney fee. The association never sent me an initial notice and request for payment. I also received unexplained legal charges on my account Iedger, which I later found out were passed on to me from the attorneys correspondence in my foreclosure case. I believe the way the attorney and board applied these charges is illegal.
Most likely yes. A foreclosure that requires the participation of the association without its fault will result in fees being inccurred. Your condo docs will probably have either provisions, bylaws or rules that make you liable for costs incurred by the association because of you. But without a review of the documents, no firm answer can be given.
