I am a man and I work in the security industry for a local social club. Long story short, the owner's girlfriend (the relationship being unbeknownst to me) gave me her phone number and began texting me. Once I found out who she was, I stopped. A few weeks later, I called in sick to a shift (I almost never call in). The next day I got a call from the head security guy saying the owner said to let me go. I asked why and he cited because I called in "frequently". I pointed out that this was not true and cited another security person (a woman) that had only been there for a couple months and had called in 8-9 times, to which he replied, "well we would have let her go except for we need to keep a woman on staff". Is this legal?Also, he cited that the cut was because there were too many people on staff. SO he basically admitted that she had called out infinitely more than I had but she got a "pass" because she was a woman.
You may very well have a discrimination case against your former employer. In very limited circumstances, when the discrimination is due to bona fide occupational qualifications, is it allowed. I'm sorry to hear you're dealing with this. However, it depends on a few things. It depends how big your employer is. It also depends if the 'social club' requires pat downs or frisks of its patrons. That could be a reason why they need to have a female on the security staff. I'd suggest you speak with an employment attorney to discuss your rights and your specific situation. Good luck.
