resulting in DMV suspending my license due to use of a motor vehicle in the incident. It is a very large amount of money in which i am certain i am not responsible for in anyway. My questions: Is this legal? Was the video taken during the incident used in the case? And why didn't my insurance cover it? It is urgent that i get information about this, in between jobs with a suspended license and a high chance that I will find one soon that without a valid license/ CDL, i may be not be qualified.
It's not always required that there be a "trial" in every circumstance, especially when agencies like DMV are involved. People have their licenses suspended every day without much notice except for a letter they may have not actually received.
Suspension of a driver's license can be for multiple reasons, and do not need a trial, as indicated by my colleague.
There are procedures to appeal, to reinstate, and to have a trial, both for the traffic accident in traffic court, and in civil court.
You should consult with an experienced traffic attorney, and determine the grounds for suspension, if you do not know, and what your options are.
You are correct, that a CDL can be in jeopardy, as well as not having a valid license, so you should not wait long to find out.
