Yes of course they can, under the right circumstances. Of course you left out major details - where were you and your husband when you were contacted? Sitting in an empty parking lot at 2:00 am., outside a closed business or outside a residence in a neighborhood where you did not live? It's called suspicous circumstances and yes the cops have a legal right to investigate.

You best ask the Public Defender assigned to your case. The issue is whether the CHP officer had reasonable suspicion of illegal conduct - and of course you don't describe what you were doing sitting in the car and why you apparently had "burglary tools" (whatever they are) in the car.
