I travel state to state working construction and I cash my payroll check in different places. The last 3 I cashed the people are calling me wanting me to make good on these checks They are threatening me with the DA.
You are responsible for the checks. This is essentially the same as if you deposited them in a bank and they came back NSF. The bank would charge you a fee and remove the amount of the NSF deposit from your account. You owe them the money, and they can sue you to collect.
Now, unless they can make a case that you are depositing these checks knowing that they are no good, they cannot threaten you with criminal prosecution. That violates the Fair Debt Collection Practices Act, and there are statutory penalties plus attorney's fees for violating it.
YOU ARE RESPONSIBLE. AS YOU TRAVEL YOU SHOULD UNDERSTAND REGULATION CC REGARDING HOW LONG A BANK CAN HOLD THE FUNDS. SEE https://www.federalreserve.gov/pubs/regcc/regcc.htm FOR A GUIDE. ADDITIONALLY IF YOU ARE SAYING THAT YOUR CHECKS WERE NOT GOOD FROM THE EMPLOYER, YOU CAN BRING ACTION AS WELL AGAINST YOUR EMPLOYER.
