we adopted a child through an agency who has been in our custody 11 months now. Bio mom said she didn't know who bio dad was. Agency did due diligence looking for bio dad through ads and registry and filed with court 31+ days after no contact. It's been 7 months since court finalization. Bio dad recently made contact w/ us stating he was lied to by bio mom and didn't know child existed and only found out through hired PI. He is requesting a DNA test. Do we have to agree to a DNA test and what are the chances the adoption can be overturned.
You don't have to agree to let anyone DNA test the child. FYI: A due diligence search for someone without that person's name---may be legal--but it is not very likely to be successful. He is probably barred after six months from the date of the termination order. But I have not researched this fact scenario.
