It's happened at school because he is cutting the lunch line and started the fight then cussed me out. Then he punch me on the face and my belly. He still punch on my belly even everyone yelling that I am pregnant. I was passed out after that and got ambulance takes me to the hospital. Can I sue him and will he go to jail or his parents?
You are asking two questions here. One is personal injury about being able to sue him or his parents. Yes you can sue someone for battery if they hit you. Since he is a minor, the claim would be made against him through a parent, although the parents are not personally liable for his actions. When he turns 18 the suit would be directly against him. You would have to prove some damages and could also possibly recover punitive damages. If you want to persue a personal injury claim you should hire an attorney immediately.
The second question is a criminal law question. Yes he can be charged criminally for an assault. Based on his age and depending on the circumstances, it could be handled in Juvenile Court or in criminal court. It is possible that there would be a jail term depending on the injuries. His parents cannot be charged criminally because of his actions.
