A better way to ask the question is "could the store clerk sue you for being rude?" Every inconvenience or mistake does not warrant a lawsuit. People often respond in kind; be honest with yourself in reviewing the way you made the request to the clerk. People usually don't give someone "the finger" for no reason.

Yes, if you have $40,000 I am sure you can find a lawyer who will take the money and file a lawsuit against Chevron Oil Company; but you will not win.
Private companies generally reserve the right to refuse service (for non-protected reasons), even if it is not always best for business.
Your best bet is to contact the owner of the gas station to let them know how their employee treats potential paying customers. It's not a very good way to run a business.
That said, since there is no indication that you were refused service due to your race, religion, gender, sexual orientation, or other protected class, a lawsuit would not get you anywhere. Being generally rude and unprofessional when you are in a hurry is not actually illegal.
