we have a homeowners association who sold our house for 27,500.00 at auction they started with a lawsuit six years ago because we had a neighbor who didnt like our dogs barking, and after we paid off 5,000.00 out of 12,000.00 lawsuit, they started fining us for not having our backyard lanscaped, we have tried hard to overcome the financial hardship that our neighbor has put us through and we are current on our mortgage. my question is do we have any chance of buying back our home and what costs and fees would we have to pay to reverse the sheriff's sale. was it legal for them to sell our house in the first place
The homeowner has a right to redeem the property from the sheriff's auction for a period of time after the sale, by paying the amount bid by the wining bidder, the Sheriff's costs of the auction, and other misc. amounts., You can contact the Sheriff's Civil Division to find out how much you'd have to pay.
How long you have to redeem depends on what the Judgment that the HOA obtained says; the period could be as short as 30 days after the sale. See this statute. http://www.azleg.gov/ars/12/01282.htm.
