I owed. Law firm a bill from 2012 . I went to court and met with a representative from the firm who pressed me to make a payment plan in 2017. I explained that I couldn't afford it at the time because of health issues .
I never heard any more . I am a retired police officer and my retirement is non taxable . I am in poor health with a heart effect function of 29 . I was never notified of a garnishment and never thought of one because other than that check my balance every month is zero after I pay my bills
The garnishment took over half of my check so now I cant pay my mortgage or gas and electric bill because I need food , medication. to survive .
What can I do ?
You may want to explore filing a Chapter 7 bankruptcy which will halt the garnishment and may allow you to recoup some or all of the money already taken. You should contact an experienced bankruptcy lawyer for advise.
If that isn’t an attractive option, you can file a motion in the district court to exempt some or all of the money in your bank account. Again, consulting with an attorney can be invaluable.
