Business next to my apartment placed industrial diesel generator on its parking lot about 25 feet from my window. Generator looks like a small trailer and generates a lot of exhaust. It runs over night from 7pm to 10am. It is not extremely loud but I can hear it with windows closed. The worst is diesel exhaust, as I can smell it in my apartment. I have 2 small children and I am worried about any health effects. It is impossible to open any windows, but with windows closed I can still smell diesel fumes in my apartment. I contacted that business several times, but no response. I contacted city inspector who told me that there are some electrical problems at that business and that they are working to resolve them. It's been going on for 2 weeks already. I called police, but they told me that they cannot do anything about it. Can anything be done to stop it, how fast it can be stopped and would it cost below $5k? There are about 15 apartments on that side of the building with 50 people directly affected. I can get more residents involved. Thank you in advance for responses.
You can file suit to obtain a temporary and permanent injunction to prohibit the use of the generator or require that it be relocated. However, there are no guarantees as to "winning" or cost.
Before an injunction can issue, you will have to post a bond. That could be a problem if no individual tenant were able and willing to stand behind it.
Have you contacted the local City Attorney? They may be able to help through code enforcement or mediation. Good luck.
