I own a used appliance business. I have an unsatisfied customer who is going online and spreading different rumors about me. She has called me a thief, a liar, a pig, and a devil worshipper (I am a Christian, and live in the Bible Belt). I have saved screen shots of what she has posted, my wife has witnessed some of her rants and have also talked to my local sheriff's department about what I could do. They (Sheriff's) said it was a civil matter. Can I sue for lost business due to her libel online? Also, I know this person does not have any money, so if I win, where will that leave me? Can I garnish personal property, (Cars, TVs, other real property) if the person can not pay the settlement? She has already cost me a sale that I know of.
The best thing to do in a situation like this is contact the customer, and try to find out how you can make them happy so the reviews disappear.
Have counsel write them a strongly worded cease and desist letter in order to scare her (with the reality of what can legally happen) if she persists in this type of behavior.
If you can't make the customer happy, and if a letter doesn't do the trick, you can file suit seeking injunctive relief. Injunctive relief is an extraordinary remedy and you will have to be able to show that what the offending party is saying is untrue and truly damaging - remember you are fighting the first amendment.
