I living in texas and i dont feel that the apartments im living in right now are safe. I have a two year daughter and there has been many times when i have found nails in her bed that had fell out of the ceiling. I had told my apartment manager many times about it and they had someone come fix the roof of my unit but its still happening, after collecting 13 nails from breeze way that my daughter had found from the ceiling outside while playing outside i went back to the office with the nails and asked her what they were going to do about it and she said that they are having 3 engineers come out april 1st. I was woundering if there is anyway i can get out of my lease since they know this building is not that safe. i also have crack on ceiling in my dining room area that keeps getting bigger
Generally, if you send the manager a letter by certified mail, return receipt requested about a condition that is a threat to your family's health and safety, the manager has a week from when they receive the notice to take care of the problem. If they do not fix the problem, you may have the right to terminate your lease and/or take the landlord to court. Make sure you sign and date the letter and keep a copy for your records. Before trying to terminate your lease, you should probably consult with an attorney to make sure you have taken all the proper steps to terminate the lease in your specific situation.
