Car was purchased one week ago in GA. I ask dealer if any mechanical problems at all with car n informed him would be transportation for work and small child. Car ran for approximately one week now motor seems to be shot. Can legal action be taken?
Unlikely. You would have to show that the seller knew there were mechanical problems with the car and lied to you about them (Fraudulent Misrepresentation).
As was noted earlier, the burden of proof is steep on cases like this. Though chances are not much can be done about, you may want to call around to lawyers that offer free initial consultations and talk with them. There are some specific things that could allow you to recover. The lawyer would need to see your sales contract to know for sure if they properly disavowed any warranties.
Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not. What determines Avvo Rating?Experience & background
