We been living in this aprtment unit for two years now we had a number of problems within this two years but now we have bed bugs in our unit after a new tenant move in above us. Orkins the pest company was out here a couple of days ago and inform us that they need it to check our unit after they found that the unit above was infested with bed bugs they found bed bugs in my daughters room and in our bedroom small amounts. but now we will need to trow our beds out and possibly our couches can i get my landloard to repay for damages? including relocation? city of van nuys CA thanks!
Unfortunately, this is a gray area in the law, because there is no specific statute that spells out a landlord's responsibilities regarding insect infestations. That said, there is a warranty of habitability implied into every residential lease. If the bedbug problem is making the unit unlivable, then you may have options ranging from "repair and deduct" [you may be able to deduct the costs of replacing furniture] to "constructive eviction" [you may be allowed to break the lease if the infestation is serious enough].
