I was discharged bankruptcy early this year and my husband was not. Even though our mortgage payments are not showing on my credit report , does this mean I am no longer on the mortgage? My husband or soon to be ex wants to sell the house, will he still need my signature to initiate the sale? I am going crazy here, he is really being mean.
The bank is not reporting your payments to credit reporting because you have no personal liability on the loan. This means the bank can foreclose but they cannot come after you, they can only take the property. Everything else remains the same. The bank can still foreclose. You are still on title and the property cannot be sold with out your consent just as the property cannot be sold without paying the Bank.
