Foreclosure should not have taken place as we believed we were in review for a home loan modification.
Unfortunately, there is no legal mandate that a bank modify your loan. If you were in default, the bank could elect to pursue any of the remedies detailed in your promissory note and mortgage including foreclosure. It is possible that you may have a defense to the foreclosure, but the fact that you were under review for a modification alone is not a defense.
