I have a Life Insurance policy on my life, that I am the owner of, with the named beneficiary named as a Revocable Trust that I have revoked. The trust included my divorcing spouse as a trustee before I revoked it. We also have a prenup waiving support.
Is it ok for me to change the beneficiary since the current beneficiary is not my ex spouse anyway, and she has waived support in her pre-nup?
Once the divorce petition has been filed and served, you can't change anything without the other party's agreement or by order of the court.
I don’t think the judge would be impressed by the argument you present if your wife would have been the beneficiary.
