My bother was accused of rape and based on the evidence that I submitted to his PD the young lady has been sneaking out of the house at night when everyone was asleep and has been sexually active and having oral sex with strangers from Face Book and some other possible sites. Some of the males have been adult and some her own age. Can anyone please help us with this case? He has a court date for an indictment on the 12th of next month. My family could really use the help of an aggressive lawyer as the PD office seems to be about as worthless as a wooden nickle. Please help us out im sure we can make some kind of payment arrangement if Pro Bono is not an option.
Pro Bono is generally not an option in criminal cases because indigent defenda t can receive free representation. You should keep in mind that before you call the PD as worthless as a wooden nickel that your definition of evidence and the laws definition of admissible evidence are more than probably two very different things. Just because a lawyer is privately retained doesn't make him/her more aggressive and it doesn't make the rules of evidence any different. That's not to say that you wouldn't benefit from a privately retained attorney but you should be prepared to pay. I suggest that before going out on a limb that you/your brother sit down with the currently assigned PD and discuss the strengths and weaknesses of the case and wha if anything the game plan might be. If at the end of the day you still don't feel comfortable you can look to retain an attorney. Most attorneys would give you an initial consult for free, you can discuss payment arrangements at that time.
I suspected this was a statutory rape case. The laws on this make it very difficult to defend. if the issue is "consent" the case is defensible in many ways. If the person is under 16 and there is more than 4 years difference in age there is a real problem. The PDs are swamped with cases. They often work on them as they become older since there are so many ahead of the newer cases. It is very difficult to find "pro bono" criminal defense attorneys because the PD exists. The case has to have some attraction to a big firm since small firms or solos cannot afford to provide free representation. Good Luck.
Based on the facts you have stated, this doesn't look good. I don't know of anyone that would touch it for under 5k. Best of luck. Personally I'd help the pd and not disparage her or him.
