Most of the AST units assigned to highway patrol duty are equipped with DVD cameras with sound. The technology used in the AST system is the camera is running continuously, but only when the blue lights are turned on, or when the officer pushes the record button, will the DVD recorder capture the information, plus the previous 30 seconds.
It has been my experience that in most situations, the DVD aids the prosecution and not the defense. However, that is not always the case. It is absolutely in your best interests to hire a qualified criminal defense attorney to file a petition for discovery and seek the DVD recording prior to trial.
If a DVD recording was made, but not provided to the defendant upon proper request, that may be sufficient grounds for a suppression motion under the Brady rule. An experienced criminal defense attorney will be able to assist you in this matter.
