I applied for early release of home confinement which should have been August 22nd. Today I left for five minutes to get my lost dog and my home confinement officer came and caught me not at home. He said he was writing me up for a technical violation.
Does this mean I won't be eligible for early release of home confinement?
This is my first technical violation or any violation of any kind. I have completed all programs and
paid all fines.
My officer was here when I pulled up with my dog and I explained my situation. He said he had no choice but to file the violation with the Judge since I didn't call him first.

It sounds like you have been sentenced to probation with some home confinement on the front end. Just applying for early release won't get it done. You will need to set the matter for a hearing before the judge as the State Attorney's Office has the right be heard on the matter. This incident will not help your chances as it sounds like your home confinement officer is going to violate your probation. It sounds like you need to line up an attorney for a violation of probation hearing.
It will depend on what happens with this violation of community control. If the Judge ends up dismissing it you may still be able to get off community control early, however, it will be more difficult to do now. You may want to have a lawyer ready and lined up in case a VOP does come down the wire and you are arrested.
