Recently I applied for H1B in premium and it got approved but there was some mistake in I-94 dates in I797 petition. Based on approval, I applied for my wife H4-EAD and with all applicable docs. My lawyer after few days sent email to USCIS for dates issue and they replied back that they will be sending new I-797 for me and my wife with corrected approval and I94 dates. Since now I’ll be getting new I-797 with extra one year, is there a way I can resend new I797s approval to USCIS for H4EAD.
It is amazing that after discussing the work your attorney is doing for you, you then turn to AVVO to ask a question which your attorney is being paid to answer. Even if that attorney does not technically file the H-4 EAD, he/she can still answer your question. The answering being you can send CIS whatever you wish to; it is unlikely they will adjust their process.
You can file the updated FORM I-797 with the USCIS Office processing the FORM I-539. Hopefully, your filing will be noticed by the adjudicating officer prior to the final adjudication.
