I was coming from work and my wife was in alot pain because she is positive for preterm labour so i was in rush
Any how got pull over by cop for doing 60 in 40 but did nt mention on ticket how he clock it
Also i acted like an idiot at that time by saying that i just went to gas station to grab cigs and have to go to washroom
The only reason i got panick was that this is 1st time i got pull ovr and the way the cop came to me like 1 his hand was on his gun so i panick i did nt knw whatto say
Anyhow i checked after that the limit he mentioned on the cite was 40 but actual limit on sign is 45 so i was 15 above.i want to ask that is it posible that the cop would have followed me for about 1.5 miles back where the limit was 40 but just for .3 miles?but the place i believe that he saw me was with limit 45
Want to ask that is it psobile that he followed for such long?also is it posible that on court if i give them the pics of the actual 45 have heard that they can amend the charge but if so do they have the authority to change the speed whuch he wrote on citation 60 at which i ws going to 65?can they do so if he tried to give the break by writing les speed than if he cloced at 65?
Possible? I am sure its possible.
Likely.....on your own? No.
Reckless is a misdemeanor CRIMINAL charge you understand, not a mere speeding ticket.
Get a traffic law attorney involved IMMEDIATELY. You don't want a lifetime criminal record.
NOT a do-it-yourself project.
I changed this to speeding and traffic so that it is more likely to be seen by attorneys who can specifically answer your question.
You should seek local counsel to assist you with potential defenses. Reckless driving is a Class 1 misdemeanor. While your speed is unlikely to warrant jail time absent extenuating circumstances, the charge is still a criminal conviction that could impact other areas of your life. Your best strategy is to consult counsel who can give you expert advice on the best way to proceed. Good luck.
Why on earth did you say something like going to the bathroom when your wife's pain was the actual reason? Did she go to doctor or medical care provider? Did she call them? If so, take documentation to court. The officer will remember what you said for reason for speeding. Get a certified car speedometer calibration and your current driving record. Find an attorney that practices regularly in Loudoun County or where you were cited and contact them immediately. You can take the Safe Driving School every two years and help with your Driving Record, but do not take if you lose the benefit of the plus points. Ask the attorney for clarification if need be Take pictures of the road showing sped limit signs. Take an overhead Google picture to help with your other pictures. You do not want to plead guilty or have that conviction on your record as Reckless Driving is punished as a Class One Misdemeanor of up to 12 months in jail, $2,500 fine and suspension up to 6 months and a minus 6 point conviction. Good luck.
None of my comments on AVVO's website constitute legal advice. It is only food for thought for possible matters to address with a qualified lawyer in your jurisdiction.
