Since I know it is important to fill every document out properly I wanted some advice on how to fill out a counter motion. What are some good examples of how to fill it out? I understand that I have to accept or deny if I deny I must have explain what actually happened right? Well how do I answer to him saying that my "abuse" has caused him insecurity, a feeling of hopelessness, angry, sad, and distracted from work. He's been very abusive since he kicked me out pregnant so do I counter it by saying he was abusive I wasn't?
As a general rule, for each allegation made in the Motion which was filed by the opposing party, with which you disagree, your opposition should so specify. Further, if you desire to have the court make orders which are not requested in the Motion filed by the opposing party, you can also include a counter-motion, outlining your requests and the legal basis for the relief you seek. Beyond this, it is difficult to give more detailed direction. I strongly recommend that you consult with an experienced custody attorney to discuss the details of the motion and your anticipated opposition and possible counter motion. Hope this helps and good luck!
