I hade a case in Wayne county in Detroit Mi. The crime I did was Attempt to do Great Bodily Harm less than Murder.So they sentenced me 2 years under hyta probation and I had to serve that in prison at thumbs correctional faculty. I did 16 months out of 24.I got out on a early release basically you can say its good behavior but my question is How do I know if I'm on probation. They didn't tell me anything or give me no kind of paperwork when I left the prison?
There are a lot of important details missing from your scenario to give you any kind of answer that your could rely upon. My advice to you would be to get a copy of your judgment of sentence to see exactly what your sentence was. If you were sentenced to prison under HYTA, my guess is that you are still on probation after you get out of prison. You indicate that you were sentenced to 24 mos, but only did 16. This is incongruent with Michigan's Truth in Sentencing scheme. There is no "time off for good behavior" in a Michigan prison sentence. You must do the entire minimum sentence before you are paroled. I do not think that you are going to get a reliable answer online, so I would seek out your attorney who represented you on that case and pose the question to him/her.
The best thing to do is to check your court file. At the end of probation, there is a discharge order. Although, if you went to prison, you were probably not on probation. The question now is, are you on parole. You would know if you were given a parole agent on release. There are a couple of things you can do to get some peace of mind in addition to looking at the court file. First you could just call the probation department and see what your status is. Second, you could check your status on the OTIS web site. Third, you could run your ICHAT criminal history to see whether a conviction is showing up for the GBH charge. It sounds like you are not on probation or parole, but you want to follow up to make sure there is no conviction showing up on your criminal history.
