Approximately 2-3 months before my separation we incurred a pretty costly home repair that was financed by the other party’s family member under a verbal agreement that the family member would be repaid by us. Approximately 2-3 months after said repair was completed, I was asked to vacate the house and later served divorce papers. Per decree, I’m entitled to 50% of the house when sold. Now that ex is selling, they are trying to withhold that amount from me. Am I legally obligated to pay for this? If yes, can the ex legally withhold the funds when it is actually owed to the family member?
Your rights and obligations with respect to the house depend entirely on the specific language contained in the decree. I suggest that you consult with an experienced family law attorney to discuss your specific situation.
