This is my first ever drug charges but I do have the following on my record.
F3 - Robbery-Take Property Fr Other/Force 1 18 § 3701 §§ A1V F
M2 -Theft By Unlaw Taking-Movable Prop 18 § 3921 §§ A
And 2 or 3 DUI convictions.
I have managed to get clean since the indecent. I am not sure if that has any impact. I also am a caretaker for my elderly mother and gainfully employed.
The public defender told me due to my record I may be facing 3-6 months in county jail.
The possession was for 2 empty bags of heroin that were tested and came back positive.
Congrats on getting clean - work your program. You need to hire an attorney if you can - Bucks County DAs and Judges are no picnic. Good luck
The short answer is, yes you are facing jail time. Your public defender knows the system very well and can help you work out a plan to avoid it. Your criminal history has put you in a bad place. Your recent treatment program will weigh heavily in your favor with the judges.
Please excuse my brevity and any typos as answers are often given using a cellular phone.
The first thing you should do is start interviewing local attorneys to represent you for this case. Generally speaking, in Bucks County, you don’t expect to get jail time for such charges but they will look into your prior record before the judge decides on punishment. Additionally, there is a mandatory six month lease and suspension if this is a first offense possession and you get convicted.
Get a local attorney who is familiar with the local court system. Local attorneys have good relationships with the judges and the police, and may be more aware of any special programs that might be available to you.
If you have gotten clean since this happened the judge will absolutely take that into consideration and you should get proof in writing of any treatment that you have received.
Avvo is a good tool because you can see rarings and read reviews from former clients. Most attorneys, including myself, give free consultations either over the phone, or in person. Start calling around. Best of luck
