Thinking about moving from CA to WA where I have more family support. My child is 2 almost 3 and we are currently living with her father however we are not married and he is not on the birth certificate. We have no child support agreement and have not been to court to establish custody. Am I allowed to move my daughter out of state?
Technically, since there are no orders and no judgment to prove he is the father, you can move without his consent. However, he may react and file a paternity action to establish his parental rights and oppose your move.
