My mother just passed, and my mother has voiced to me only over cell phone(call) that she didn't want my brother to get any of the shares she owned because of the acts of burgurly he commited against our family and herself multiple times. No documents on the theft from us cause what mother wants to call the cops in her son, but I do have evidence from other situations where he was convicted and documents showing my mother and brother weren't exactly close. My brother still is commiting acts like this unfortunately is there any way I can stop the distribution of equal shares being distributed
If your mother had a will disinheriting your brother, he will not receive shares. If her wish was only oral, it doesn't count. If your mother had no will, all children will share equally. There's nothing you can do about it if she did not put this in writing in a proper will.
