I was recently told in health class this year that the age of sexual consent in NY is 17, with an exception that protects the older partner from being convicted of statutory rape: so long as the younger partner is less than three years younger (i.e. 18 and 16) at the time, it is legal. However, I heard that it is in fact FOUR years that makes the difference. Which is the cut off: three years or four? I ask because I am 18 (7/14/'94) and my boyfriend is 16 (5/19/'96) and my dad thinks it's illegal. We haven't had sex, and won't for quite some time, but I'd like to know the specifics, especially since there are discrepancies.I've also heard that there is no buffer zone and the cut off is 17 no matter what.
