The age of consent in NY is 17 no exceptions. Having sex with someone under 17 in NY is a crime. There is an age gap provision that would preclude a statutory rape charge but there are other applicable criminal offenses. Wait till he is seventeen otherwise you can get in trouble.
The age of consent is 17. Sex with someone younger is a crime. If you have sex with your boyfriend before he is 17 it is a crime for which you can be arrested.The three year age differential applies to statutory rape.
There are different levels of crime but sex with anyone under 17 is some type of crime in NY.

Sex with anyone under 17 is illegal period. It will not be statutory rape b/c of the age difference but there are multiple crimes that can be charged against the person having sex w/anyone under 17. Even if the person says "yes", it's a "No" under the law. Period!!!
