My conviction got reversed and remanded back to the district court, do I have to go back to jail pending trial? I have served the entire sentence that was required of me on my judgment and sentence. Where I am going they do not have pretrial services.
If you have served the entire sentence why should you have to go back to jail? I could only see that happening if you were retried, reconvicted and resentenced and if, in the meantime, you had committed a new crime that would result in a more serious sentence than you got the first time. But your lawyer is the one to ask, not an online Q&A forum.
