I feel concern about my eligibility to get my green card if I leave the US on advance parolee. First, I came to the US as a visitor - B visa, and was admitted as such. My plans changed and I ended up filling for AoS while F2A was current. My i-485 was pre-adjusted but I have not been able to get my green card since my PD is not current (the category retrogressed) yet.
I want to visit my home country and I am worried that If I leave the US that at the fist place I am not going to be able to get in again - to be paroled? and even if I am paroled that later on, when my PD becomes current, I might have problems because of it - being paroled not admitted, since my category is F2A? Can somebody help me figure out all this? Thank you
have you been getting legal advice for your decisions on all of this? also, you do know that advance parole is something you apply for before you leave the US? not - as you seem to imply here, that you leave and then ask when you return.
You need to contact your US immigration attorney. Advance parole does not work with periods of unlawful presence.
Hopefully you were maintaining status until the I-485 was filed?
