My ex and I are going through a divorce.... I adopted her daughter prior to this. The biological father had back child support that he is now trying to pay. My question is........ in this horrible divorce process my ex is coming after me for over $900 in child support a month for ONE child that will be 18 January, and I'm the one that adopted her child, but she is currently receiving back child support from the biological father......... does this sort of thing stand up in court to where i'm obligated to pay her child support one, and two do i even owe her child support since she's receiving back child support from the biological father???? Please help......
The back child support for a prior period of time has no direct bearing on whether you will be obligated to pay support going forward, until your daughter is no longer eligible for child support. There are a number of factors that go into determining child support. The first thing you need to do is simply schedule a consultation with a family law attorney.
