My lawyer filed a response to an intent to deny an I 130 my wife has filed for me. Three (3) months down the lane, I have not received a final decision. I went to court and the government attorney and my attorney agreed to administratively close the case pending adjudication of the I 130. After the I 130 has been responded, then my lawyer can file to recalender at the court. Can I file to get a work authorization whilst waiting for an action to be taken?
Ask your lawyer, not AVVO.

Did you ask your lawyer this question?
If so, what did he/she say?
If not, why are you asking us instead of him/her?
He/she has all the facts, we don't

IMPORTANT: Mr. Murray's response is NOT legal advice and does NOT create an attorney-client relationship. You should NOT rely on this response. Mr. Murray's response was generated without conducting a full inquiry as would occur during an attorney-client consultation. It is likely that the response above may be made less accurate, or become entirely inaccurate, as you, i.e. the questioner, disclose additional facts that should only be discussed during a private attorney-client consultation. I strongly recommend that you consult an attorney who is licensed to practice law in your state (or, in the case of immigration law, an attorney in ANY state), whereupon all relevant facts will be discussed. From what you stated, I am guessing that you were in removal proceedings. Now that your I-130 pending in USCIS, it does not offer you any immediate immigration benefit of work authorization. Talk to an experienced immigration attorney.
