I'm currently on asylum pending. I've got my notice from USCIS on July 15, 2016 and my stamp in the passport says July 14, 2016. I currently have an EAD and am employed. The employer is willing to sponsor me for H or E visa if I qualify. So,y question is can I change my status to H1B or EB (2-3) in my situation.
I have already talked to a couple of lawyers and some of them say it's possible others say that adjustment of status is only possible if you are in a legal status. So, would you please clarify if I'm in legal status or not.
Your help is greatly appreciated.
If you are not currently in valid, nonimmigrant status [and it seems from your description that you are not], you cannot file to change your status in the US. But you may be able to get a new visa abroad.
