In a situation where somebody causes a car accident and drugs were found in the car leading to a felony drug arrest, are they automatically DUI tested if they and the other party are injured and taken to the hospital?
Typically when there's an accident and there's drugs found in the vehicle they're going to test the blood for substances and if there are substances in the blood it is absolutely a DUI with injury and can be considered a DUI with great bodily injury witch may be a srike
This is a very serious offence I can have extremely serious consequences I need to speak to and quite frankly hire a good attorney
This is a question more about police procedures, not criminal defense. Anecdotally, my answer would be I hope the driver is automatically tested for DUI based on alcohol and drugs.
Under these circumstance it's quite likely the police collected a blood sample.
