During the arrest, the police found out he had warrants out for violation of probation on a sex with a minor (4yrs suspended with 5 years probation) and failure to appear for a 2nd degree assault. He has been bonded at 130,000 total and unable to make bond. He has been in jail for the past 2 weeks and had a court date yesterday but his PD asked for a continuance on the harassment/resisting/ failure to appear. How long does this process take and will he be given a long sentence?
Well I think your friend ough to be worried. while he's new criminal charges are not necessarily that serious, The fact that he has 4 years hanging over his head on a Violation of Probation, almost guarantees him some jail time. I would estimate around 2-3 years. The entire process can take at least six months to resolve
If he doesn't mind doing time then he has nothing to worry about. The fact they set his bond at $130,000 indicates they are serious about putting him away for a while. My guess is he will get at least 2 years on the vop and probably an additional 2 for the assault/failure to appear.
The process can take anywhere between 6 to 9 months (give or take). Since he's being held on bail, every day he's in will be credited to him when he is sentenced.
