Could my child's father just take her and keep her if he hasn't seen her in a year and isn't on the birth certificate? & If so if I filed for emergency custody would he have rights or still have none? And how do I go about it? He doesn't pay child support either, and we have no contact whatsoever. I just want to be on the safe side. Never married either.
Assuming you didn't sign an acknowledgment of paternity and he hasn't proven paternity, he has no rights automatically. Tell him to go to CSEA, get a paternity test and then you can talk. Of course, CSEA will tell him that he will have to pay child support.
