You can file just before the child is born or right after. Assuming you are not married to the father, you would have to file for paternity first. After paternity is established, the case would automatically turn into a child support case.

Yes, you can "sue" him in Family Court and seek that he take a paternity test and pay you child support. This is generally called a Petition for Child Support or a Paternity Petition in New York Family Courts located in every county in the State of New York.
The Court personnel should be able to walk you through the process if you cant retain an attorney.
