I'm disabled, I get no ss a or ssi, filed in 2009 denied all the way! I have no income right now,my husband does.I need to live in same place till I get a place to live.
It seems that you have 2 issues:
(a) Are you separated for purposes of Family Law if you move into separate bedrooms?
(b) Are you separated for purposes of Social Security Disability or S.S.I. Law if you move into separate bedrooms?
Courts and family law specialists are decided over the first issue. In my view, if you can objectively show a permanent separation of the hearts then you can live under the same roof. More than just your bedrooms must be considered, as their are many kinky marriages with separate bedrooms and many with no sex.
I decline to address S.S.D./S.S.I. law.
While there is no law that says you cannot be separated and live in the same home, there will be a presumption of fraud if the separation is used to acquire public benefits.
