Want to deed back timeshare to resort. They are basically worthless.Are paid off and up to date on fees.
Been told must probate in Nev. Already probated in Canada-timeshares only US asset
Do not want to probate in US and pay unnecessary fees
1 Must we probate?
2 If yes, can we probate for the timeshares only not rest of estate held in Canada?
3 If no what are our options?
The only assets subject to Nevada probate would be the timeshares. If the timeshares have an aggregate value of under $100,000 a set aside petition may be filed with the court and the asset transferred to the beneficiaries. Alternatively, the beneficiaries may take no action and abandon them in the Decedent's estate by not pursuing them. You would only need a probate in Nevada if you want to transfer the time shares to the heirs. The Nevada probate would only be for the time shares, not for the rest of the estate held in Canada.
