Agree with the other answers: unless there is a contract that limits or prohibits the employer's ability to do this, the employer is free to do this.

Your employer has to pay you for your work, but doesn't have to guarantee you work hours. You mention that the company is in talks with "the union." Your union should have a collective bargaining agreement with the employer which may regulate work hours and such practices. If the contract does have provisions, then file a grievance with the union. If the contract does not, then you and your co-workers should advocate that the union, in their next contract with the employer, address this practice.

Unless you have a contract (or union protection), you are an at-will employee and therefore can be fired for any reason or no reason so long as it is not an unconstitutional reason such as based on race, gender, religion, etc. Based on that, I see no violation here so long as you are getting paid at least minimum wage for the hours you actually work.
