I filed a motion pro se out of state, as I do not have the funds for a lawyer and TRLA is hard to get ahold of anyone for app process. The motion was filed against my daughters mother for Enforcement of a existing visitation order, due to the fact she will not follow it and thinks missed support payments is grounds for not allowing contact with my daughter. And she had her lawyer file a general response requesting jail time for back support for 4 months of missed child support payments. Court hearings have been getting delayed. In the time of those delays a cps case has been opened on my daughters mother for her other child that she has in her care . My daughter was ok but that due to the fact her grandmother is he main caretaker of my daughter when my daughters mother is suppose to have her in her care as per the order and in the order I am suppose to have a say in that also. we are supposed to make decisions together and my daughters grandmother where my child resides picked up a drug charge for sales of narcotics (crack cocaine) to be exact. Well the mother of my daughter had a change in heart due to those situations and wants to settle out of court.
this question ultimately relates to a child....if you can work this out, you need not file anything...it is better for the agreement to be in writing, but it need not be...it is important that the law suit be withdrawn...a voluntary dismissal is filed with the court.....that said....that said....there is a child involved....lawyers can be very important.
You need to repost this using the city and state where the legal proceeding with your motion is pending. These laws vary greatly from state to state and Texas lawyer are going to be lost as to what to do in another jurisdiction. Also, delete "litigation" as a tag. This is all child support and family law.
