I am trying to send notice to my spouse regarding provisional hearing for "dissolution of marriage". But he seems to be out of USA. Currently case status is showing "Service Returned Not Served" and hearing date is after 10 days.
What will happen in this case? Will court provide the new date?
Or court will continue with the hearing ?
What if my spouse will never come back to the USA? Will case remain pending forever?
It's not easy to serve someone who is out of country. You may have to file an affidavit. You may have to publish an ad. I would see an attorney for that as you would not likely get a court's judgment without service.
