She’s coming at the end of the month and will be here on her tourist visa. Is it ok file the I-130 for her while she’s here? If so, can she stay here until we get an answer? What’s the average time it takes usually to get an approval for a parent of a us citizen?
You should not file just I-130 but the entire AOS package. You should not do it earlier than 90 days after her visit. It will take probably a bit over a year.
