My husband is in the military and he was arrested for assaulting me. I've given statements to the police but didn't press charges. The military is trying to chapter him out without being tried first.
The Army does not have to have a courtmartial or civilian conviction or deferred adjudication to chapter out a member for misconduct, serious or a pattern, or for other administrative grounds. You better talk to counsel before you go recanting statements and possibly jeopardize yourself for making false statements. He will be entitled to military counsel or he can retain civilian counsel for the administrative separation board procedure. He should probably try to get into some kind of rehabilitation program for family violence and try to persuade the board not to separate him. He needs to consult with military counsel.
