Other party knew I was going out of state he served me right before I left. I haven't found legal help/lawyer. I filed (today)a motion to extend response time due to not finding legal help yet(I don't want to sign without that and some information was wrong in summons)My 21 days is up tomorrow. Does that count as responding or can they exclude me for not responding/filing/signing it, in time like the warning at the bottom of my papers I was served with says?
A motion or application to the court for more time generally will give you some time before the court rules. In other work on getting your self a lawyer....but get that motion in....today.....
