My boyfriend & I have lived in our home for 2.5 years now & he has joint custody with his ex wife. His son moved out of his mothers house last winter as he couldn't obey her rules & moved in with us. he didn't have respect for our rules either so moved out the end of September & in with other people. Now the people he moved in with are selling house & he wants to move back in with us. I don't want it and his mother says she will take his father back to court but is not willing to let her son move in there either. His son is working a part time job & doing a real estate mentor program. Even though it is our house the house and mortgage is solely in my name. Can his mother take his father to court for child support as he has moved out of both of their house willingly? Neither of them pay support to each other.
Emancipation is a factual event. You should bring your settlement agreement and Judgment of Divorce to a family law attorney for review. Good luck.
