I live in a 76 plotted subdivision where 65 homes have been sold. The developer has 8 plotted lots left to build and approximately 3 unplotted lots. Last year only about 36 homeowners paid the $100/year HOA dues out of approximately 61 who were sent an invoice. It is obvious that many of the homeowners are not "buying in" or perhaps even wanting any HOA. The subdivision is coming to or already at a transition concerning any HOA involvement.
The answer to your question depends upon what the documents creating the subdivision say. You need to consult with a local real estate lawyer for further guidance.
